    【本報訊】粉嶺北馬屎埔村農民黎永權被指佔用四萬多平方呎政府農地,地政總署昨發起收地行動,村民與地政人員對峙逾五小時,收地行動終暫緩。黎永權表示,該幅土地招標時,列明考慮價格及各種因素,後來竟變成價高者得,中標價每年十二萬元,屬「天價」農地。他批評招標根本是陷阱,企圖逼走農戶,方便日後收地發展新界東北。地政總署回應指該官地去年接納出價最高並符合招標規定的標書,必須尊重招標結果,被指「迫遷」是罔顧事實,亦間接鼓勵非法佔用官地,署方對該行為表示遺憾。

    黎永權在該處耕種二十多年,目前主要種通菜及魚翅瓜等農作物。他前年獲地政總署通知,指部分土地屬官地。後來土地公開招標,由一間剛開業的公司中標。黎說:「我入標又變咗價高者得,我唔入標又話我棄權。」
    他昨與多名聲援的村民,高呼「地政滾蛋,停止收地」等口號,堵塞地政人員前往農地的去路。地政人員欲拆除鄰近土地圍板,村民隨即危坐圍板阻止收地工程,情緒激動。

    黎永權要求繼續在原址耕作,強調農地上仍有逾萬斤、共值數萬元的魚翅瓜,而鋪設水喉等設施無法搬離,質疑地政總署批出標書時,漠視他的訴求。地政總署總地政主任鄺兆銘表明,要轉交土地予中標者,不能停止收地,縱容佔用官地人士。因村民情緒激動,他承諾本周內不再動工,再約見黎永權及立法會議員張超雄等,商討解決方法。

    Welfare minister tells the old folk whose nursing homes look set to be bulldozed for new town to give him time to come up with solution

    Welfare minister Matthew Cheung Kin-chung pledged yesterday that he would exhaust all possible options to come up with a win-win solution before more than 1,000 elderly people were displaced by a proposed new town development in Kwu Tung.

    “There are still four years to go … there’s room for us to talk with the Development Bureau and come up with a win-win proposal. Please allow us some room and time,” Cheung said after meeting residents and managers of the 25 homes in Dills Corner Garden, Kwu Tung, near the Hong Kong Golf Club at Fanling.

    But 78-year-old Jennifer Wang Yuzhen said that did not ease their fears and worries. “It’s your task and your duty to take care of us …We could be gone in less than four years’ time,” she told the minister.

    The South China Morning Post reported yesterday that the Development Bureau had increased space for community facilities in the new town, raising the possibility of moving the displaced elderly to a nearby site.

    Under an existing plan, the residents would simply be scattered to other elderly homes in the city.

    Lawmaker Fernando Cheung has also proposed allocating the elderly to a new nursing facility in Tuen Mun, which will be the largest in the city when it is completed by the end of 2017. His idea was welcomed by developer Henderson Land, who donated the site, and the home’s future operator Pok Oi Hospital.

    The operators of the homes at Dills Corner, most of which are privately run, have suggested redeveloping the homes in the new town but concentrating them into taller buildings on a smaller site to minimise their impact on the future development.

    However, the minister warned that some places at the government-funded facility in Tuen Mun would cost more than HK$10,000 per month and could prove unaffordable to many of the displaced residents of Dills Corner Garden, where monthly payments are generally a few thousand dollars.

    As for rebuilding the 25 homes, he pointed out that the existing village would be at the heart of the future new town, making the redevelopment proposal less feasible.

    Chan Yuen-han, chairwoman of the Legislative Council’s welfare services panel, urged the minister to come up with concrete proposals which could be discussed with the residents.

    “Hong Kong should treasure this kind of elderly village, where older people are living in a healthier environment and recovering more quickly [compared to those built in the urban areas]. It helps keep down the city’s medical costs,” she added.

    Dills Corner was converted from a former military barracks and opened as a community for old people in 1998. There are 25 two-storey blocks lined up along an avenue, each with a garden.

    Wong Cheung-ching, chairman of the Dills Corner homes association, said the government should be taking as much care of the elderly in private homes as those in government facilities.

    “They need familiar faces to take care of them. Asking them to adapt to a completely new environment is a torture. I’m afraid they will pass away one by one.”

  • Hope for elderly people set to be evicted for new town


    More than 1,000 residents of Kwu Tung nursing homes will have to move, but new proposals could help them keep their community together

    More than a thousand elderly people set to be displaced by a new-town development in Kwu Tung have been given renewed hope that they can continue to live together with the nursing home friends many now consider their family.

    Two new relocation options have emerged for the 1,300 elderly people living in 16 nursing homes in Dills Corner Garden in Kwu Tung, Sheung Shui. They could be moved to a government site within the new town, or to a planned nursing home project in Tuen Mun on land donated by tycoon Lee Shau-kee.

    Welfare minister Matthew Cheung Kin-chung, who will visit those affected today, will have the final say over their fate.

    The options were made possible by changes to plans for the new town and – in the case of the Tuen Mun project – an idea floated by lawmaker Fernando Cheung Chiu-hung in the Post.

    The existing plan would scatter the residents to different nursing homes, while compensation would be offered only to those now receiving government subsidies – about a third of the 1,300.

    “We would rather stay together until the end of our lives,” said 68-year-old Quincy Wong Wing-kin, who has lived in a home without government aid for six years and would consider moving with his “home-mates” to Tuen Mun. “The poorest people in the world are the lonely ones.”

    Close to one-third of the residents have lived in the serene area for more than ten years; the eldest is now aged 106. Both the Welfare Bureau and the Development Bureau have been reluctant to pledge to resettle the whole community in the same district.

    But development officials are now considering creating a site in the new town that could accommodate the residents. The idea gathered pace after a Town Planning Board last week approved a government proposal to increase the space allocated for a GIC (government, institution or community) site in the new town by five hectares to cater for “future needs”.

    But uncertainties remain. It is unknown if the welfare minister would request the GIC site for the relocation, or if new nursing homes could be built there by 2017 when the elderly will be forced to leave.

    Separately, both Henderson Land Development and Pok Oi Hospital said they are open to the idea – raised by Fernando Cheung in an interview with the Post – of relocating the elderly residents to their
    Tuen Mun project, which is due to provide 2,000 subsidised and private nursing home places by the end of 2017. The site was donated to the hospital by Henderson Land chairman Lee Shau-kee last month.
    Pok Oi Hospital chief executive Gary Kwong Kwok-kong said the hospital would back the move if the government approved it. The hospital could not determine who would occupy the subsidised places in the government-funded project, he said.

    Tsang Kim-kwong, a spokesman for the Dills Corner homes, said the Tuen Mun proposal could leave more than 200 nursing staff jobless. But Cheung said the priority should be given to the preferences of the elderly residents themselves.

    “I don’t mind living further [away] if we can still live and laugh together. The home-mates are now my family,” 85-year-old Wan Hon-keung said.

    A Labour and Welfare Bureau spokeswoman refused to confirm the bureau was looking for a new site for the Kwu Tung residents, but said moving them to Tuen Mun could be unfair to others waiting for a subsidised place.

  • 粉嶺高球場80萬租變1000元 市值租轉象徵式審計指契約離常規


    審計署昨天發表報告書,當中第一章關於「免地價或以象徵式地價直接批出土地予私人體育會所」。審計署以不開名的方式,在報告以約6 頁篇幅特別交代港府於1999 年以年期21 年,把新界私人遊樂場地批予「某會所」的經過。

    資料顯示,當局於1930 年起把159 公頃土地租予香港高爾夫球會,每年續約。而球場延伸的11 公頃,則於1990 年起由該會以短期租約方式,以市值租金向政府租用,於1997年租金約80萬元。

    公眾實質使用比率僅1.8%

    高爾夫球會於1996 年致函地政總署,要求批出私人遊樂場地契約,最終有關契約於1999 年獲批,涵蓋整幅逾170公頃土地。就此審計署問地政總署批約原因,總署回覆指出,抵達該11 公頃土地須取道球會,故土地不能獨立轉讓;舊約每年續期,令會所不願投資,未能地盡其用。而當局已獲授權,毋須因土地面積大而徵求行會同意。

    據報告指出,規劃環境地政局1997 年已在進行全港發展策略檢討,尋找新發展區,地政總署署長曾致函指出,「球場無疑會帶來極大掣肘」,惟規劃環境地政局稱該用地四周「看來不擬進行大規模發展」。

    最終該契約經修訂後訂明,政府在根據契約收回土地時「無須作出賠償」。審計署指出,這點有違1979 年當局制訂的特別條件;而另一項偏離是,球會在契約用地提供51 個房間供會員及賓客住宿,有違地段不得作居住用途之條件。

    審計署又統計各會所開放設施讓公眾享用的時數,高球會雖每月承諾開放660 小時,但今年3 月公眾實質使用只有合共12小時,比率低至1.8%。

    新界東立法會議員、工黨張超雄直言,繳交市值租金跟現在象徵性租金相差極遠,認為當局1999 年的契約條文值得商榷,應追尋當年改變政策的原因。他表示,既然現在發展計劃改變,收地又毋須作出賠償,看不到有何理由政府向新界東北的農民收地,卻不收回只服務2000多名會員的球場。

    香港高爾夫球會昨天未有對事件作回應。

  • 東北拆長者村千老人命運未明 院友恐失「老友記」學者憂難適應倡保留


    古洞石仔嶺花園環境清幽、鳥語花香,為16 間私營安老院及逾1100 名長者聚居於此的安樂窩,當中更有逾10 人為年紀過百的人瑞。這條與世無爭的「長者天神村」隨着政府的新界東北發展,在2016 年底將遭拆遷,然而村內七成即逾800 名居於私營院舍的長者,被逼遷後安身之所未有安排。學者及議員擔心,村內長者生活儼如小社區,具一定社交圈子,遷出將難以適應以致健康或精神轉差,建議保留該處用地及改善附近配套,亦應付人口老化需要。明報記者錢瑋琪

    發展局未回應有否安老院用地資料顯示,長者村未來會發展成「綜合發展區」,對於未來有多少用地規劃作安老院舍或會否安排同區安置村內長者,發展局未有回應有關查詢,只強調一切按社署回應。

    社署發言人表示,石仔嶺花園的16間私營安老院,當中7 間參與「改善買位計劃」,共涉306 個資助宿位,署方會安排資助宿位長者入住其他宿位,私營宿位的長者在尋找其他院舍若遇困難會提供協助。

    兩層平房群前身英軍宿舍

    石仔嶺花園的前身為英軍已婚宿舍,位於擬建古洞鐵路站南面,自回歸後由政府產業署接手,至今每兩年續租一次,租出23 幢兩層式平房予安老院經營。石仔嶺安老服務聯會主席黃中青指出,目前「長者村」有逾1300 名長者,入住率近85%,院舍宿位佔北區整體達六成;當中近三成長者居住滿10 年或以上,九成依賴綜援生活,而院舍費用則由4500 至8000元不等。
    年逾六旬的黃伯為退休地政總署人員,自06 年起入住「長者村」院舍,他指村內環境廣闊,可隨時走動至院舍外的小路、草地與其他院友相聚;由於黃伯本為孤兒又無成家,已視此處為「自己屋企」,最擔心年紀較大的長者,一旦要搬走將難適應新環境,認為此舉對「老人家好折騰」。另有74 歲的林伯也憂失去村內「老友記」(見另稿)。

    團體轟欠規劃無交代安置

    聯會秘書長曾儉光批評,政府將一手建成的「長者村」摧毁,發展新界東北又欠缺規劃,至今仍無法交代如何安置村內長者。立法會議員張超雄認為,村內有逾千長者,不少有長期病患,當局不能以一般逼遷情况處理。而人口不斷老化,社署要求私位長者自行覓新宿位也強人所難,建議保留該區及改善配套。

    社工:或致腦退化者情緒問題另外,資深長者社工盧姑娘表示,長者一般需要2 至3 個月適應新環境,包括重新認識院舍設施、適應新的照顧員及鄰舍等,尤其是「腦退化」症患者,其間可能因不習慣引致行為、精神情緒的問題,故要求長者離開原有院舍,必須考慮地區、病歷,甚至能否應付市區的院舍費用,亦需要特別照顧單身無依的長者。

  • 調查:六成人撐發展高球場代東北


    環保觸覺、立法會議員范國威及張超雄,早前聯合委託港大民意研究計劃調查,訪問逾千名市民,發現有65%受訪者支持收回高爾夫球場,以成為東北替代方案。

    調查於8 月1 至5 日,以電話訪問1012 名18 歲以上市民,問題包括應否保存東北居民的生活方式、計劃是否有向地產商利益輸送以及粉嶺高爾夫球場能否成為替代方案等,問題並經研究計劃
    總監鍾庭耀確認。調查發現,除六成半人支持以收回高球場取代東北計劃外,在30歲以下的受訪者中, 高達86% 認為,應保存東北居民的生活方式,顯示年輕人較尊重當地居民的現有生活模式。

    八成年輕人:應保當地生活

    環保觸覺指出,特首梁振英曾說過發展新界東北是為年輕人,但調查顯示大部分年輕人非常尊重當地居民的生活方式。

    發展局發言人回應表示,民政事務局稍後會開展有關私人遊樂場地契約政策的檢討,發展局亦會就土地規劃及利用參與有關檢討。

  • 新界東北發展計畫誰是贏家?

    新界東北發展計畫在誠信及民望跌至谷底的陳茂波領導下,已經顯得進退維谷。在立法會休會前,發展事務委員會通過了兩項動議;一項是由我提出,要求將粉嶺高爾夫球場及行政長官別墅納入規劃後再從新諮詢。另一項動議由陳偉業及陳志全提出,要求陳茂波辭職下台。雖然兩項動議皆不具法律效力,但在道義上,政府有責任在推行最新方案前,要先向立法會解釋,她要一意孤行的理據何在,並正式回應兩項動議。

    事實上,最新的所謂「傳統新市鎮模式加強版」,只會令政府更難洗脫官商勾結的嫌疑。新界東北發展計畫已討論多年,但在○八年曾蔭權才正式以文件作公眾諮詢。當時強調的發展模式是「公私營合作」,亦即政府負責規劃,而在規劃內的土地若屬私人擁有,政府會容許私人發展,條件是配合政府的規劃,若涉及改變土地用途則要補地價。

    在這個發展模式下,地產商當然有很大興趣在規劃範圍內收購土地。因為他們可以農地的價格買入土地,囤積起來,他日發展計畫成事之時,只要和政府以黑箱作業式的機制去商討補地價,便可興建豪宅和商場,賺個滿堂紅。

    本來大家以為在曾蔭權下當政務司司長的唐英年當上特首,新界東北發展計畫便順理成章地成為發展商口裏的肥豬肉。可是,梁振英當上了特首,他表示要用「傳統新市鎮模式」去發展。這個發展模式,就是由政府規劃及收地,然後根據規劃將部分土地公開拍賣,邀請地產商參與發展。這麼一來,地產商要互相競爭,發展的成本自然高了很多,在當地早已囤地的發展商,只能以農地價把土地賣給政府,然後再以住宅或商業土地的價格、通過拍賣以高價投地。本來已放進口中的肥豬肉,豈非化為烏有?

    「加強版」放生發展商

    於是,不知道是否幾大地產商動用了他們的影響力,政府最新的發展模式,又作了關鍵性的修正。陳茂波美其名稱之為「加強版」,其實就是要放生在規劃內已大量囤地的發展商,讓擁有四千平方米土地(即四萬多呎)的私人或公司,可以用補地價形式去發展。試想想,一般人又怎會擁有超過四萬呎土地?就算投資眼光獨到的陳茂波,也只曾擁有二萬呎。除了發展商外,還有誰會在這「加強版」中得益?

    反對香港被規劃行動組成員陳劍青分析規劃土地上的擁有權,發現四大地產商在區內擁有大量土地,包括恒基(粉嶺北馬屎埔)、新世界(石湖新村、烏鴉落陽)、新鴻基(天平山村)、長實(古洞北)。他們的收地範圍都巧妙地非常配合政府的私人住宅規劃用地,而地產商之間又似乎非常協調而有序,不會出現在同一地點互相競爭收地的情況。
    最新修訂密度大幅調升在最新的修訂中,政府把打鼓嶺及坪輋劃出發展計畫外,發展的土地少了,人口卻由原來的十五萬多增至十七萬多人,意味着發展密度大幅調升了。《明報》發現,長實在古洞北擁有近一百萬呎地皮,本來是低密度住宅地段內,在最新的規劃版本,約七成被劃作中密度私人住宅地皮,地積比由兩倍增加至三點五倍。公共專業聯盟政策召集人黎廣德計算過,因為上述的修訂,長實最少可多建一百零五萬呎樓面面積,保守估計可多賺十億元。

    至於恒基則是粉嶺北的大贏家。在八個規劃作私人住宅的地段中,有六個是處於恒基的地皮上,估計可發展樓面達六百五十六萬呎,現市值達三百五十億。

  • 議員指陳說謊 促曾鈺成跟進


      工黨張超雄指,涉及發展局局長陳茂波劏房事件的景捷發展有限公司,當中七成半股權,原來屬於大股東當時為陳茂波太太許步明的Orient Express Holdings,質疑陳茂波當日指許步明對景捷沒有控制性股權的說法是謊言,他表明將去信立法會主席曾鈺成要求跟進,公民黨會積極考慮引用《權力及特權法》成立委員會調查事件,並向陳茂波提出不信任動議。
    疑許是控制性股東

      不過,許步明晚上再發聲明回應,以證丈夫沒有說謊。聲明指Orient Express在景捷所持股份,一半屬實益擁有,另一半則代Classic Success Int’l Limited持有,所以Orient Express在景捷的實益持股比例是百分之三十七點五。她強調,在景捷沒有控制性股權。聲明並指律師已查核,陳氏一家及OE在Classic Success也沒有任何權益。但聲明中,仍未披露為何OE代Classic Success持有股份及Classic Success的背後股權誰屬。

      陳茂波去年十一月在立法會大會上表示,太太許步明沒有持有涉及劏房公司「景捷」的控制性股權。不過,景捷背後股東,包括OE及Strategic Assets Holding兩家公司。當時因未有披露OE的背後股東,難以判斷許步明是否真的沒有控制性股權。
    然而,在東北囤地事件出現後,卻揭發許步明持有OE九成股權、另一成股權為兩人兒子陳天行所有。許步明持OE九成股權,而OE又持有景捷七成五股權,即許在景捷持百分之六十七點五股權,屬控制性股東,陳茂波被質疑在立法會上講大話,發表虛假聲明。
